1. Agreement to Terms
By accessing our website, ordering our pods, or using our services, you agree to these Terms of Service. If you don't agree with any part of these terms, unfortunately, we can't do business together. No hard feelings—we hope you find the solution that works for you.
These terms apply to all users, including browsers, customers, merchants, and anyone else who accesses or uses our service.
2. Our Services
ArcticRx provides temperature-controlled shipping pods designed to maintain specific temperature ranges during transit. Here's what we do (and don't do):

- NFC-enabled temperature monitoring and tracking
- Real-time temperature data and trip history
- Customer support and guidance on proper use
- Pod rental, sale, or subscription options
✗ What We Don't Provide
- Actual shipping/courier services (use FedEx, UPS, etc.)
- Insurance for your cargo (check with your carrier)
- Medical or pharmaceutical advice
- Customs clearance or international compliance services
- Guarantees against all possible environmental conditions
3. Acceptable Use
Our pods are designed for shipping temperature-sensitive cargo. When you use our service, you agree to:
- Follow instructions: Use the pods as directed in our documentation
- Comply with laws: Follow all applicable shipping, import/export, and product regulations
- Proper packaging: Ensure your cargo is properly packaged within the pod
- Accurate information: Provide correct shipping information and cargo details
- Return pods: Return rental pods in reasonable condition within the agreed timeframe
Prohibited Uses
You may NOT use our service to:
- Ship illegal substances or contraband
- Violate any local, state, national, or international law
- Ship hazardous materials without proper certification and disclosure
- Reverse engineer, hack, or tamper with our pod technology
- Use the pods in ways that could harm people, property, or the environment
- Resell or sublease pods without our written permission
Note: If we discover prohibited use, we reserve the right to terminate your service immediately and report to appropriate authorities if necessary.
4. Orders, Payment, and Pricing
Pricing
All prices are in USD and subject to change. We'll notify you of any price changes before they affect your order or subscription. Current customers get grandfathered pricing for the duration of their current contract.
Payment
Payment is required upfront for purchases and at the start of each billing cycle for subscriptions. We accept major credit cards and ACH transfers for business accounts.
Refunds
We offer refunds under the following conditions:
- Defective pods: Full refund or replacement if the pod is defective
- Order cancellation: Full refund if cancelled before shipping
- Service failure: Partial refund if our pod fails to perform as specified (requires proof)
We do NOT offer refunds for:
- User error or improper use
- Shipping carrier delays or mishandling
- Temperature excursions caused by conditions beyond the pod's specifications
- Completed shipments with successful temperature maintenance
5. Limitations of Liability
Here's the legal stuff our lawyers make us include. We've designed our pods to be reliable, but we need to be clear about what we're responsible for and what we're not.
Our Responsibility
We're responsible for providing pods that meet the specifications we advertise. If a pod fails to maintain its specified temperature range under normal conditions, we'll work with you to make it right.
Your Responsibility
You're responsible for:
- Choosing the right pod for your cargo
- Following our packing and usage instructions
- Selecting appropriate shipping methods and carriers
- Insuring your cargo (if desired)
- Complying with all applicable regulations
Important Legal Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
ArcticRx is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use our service
- Damage to or loss of cargo
- Shipping carrier performance
- Extreme weather or unforeseeable events
- Unauthorized access to your data
Our total liability to you for any claim related to our service is limited to the amount you paid us for the specific pod or service in question, up to a maximum of $500 USD.
6. Warranty
We stand behind our products, but let's be clear about what that means:
- Materials and workmanship: Our pods are free from defects in materials and workmanship under normal use
- Specifications: Pods will perform according to published specifications when used as directed
- Duration: 1 year from date of purchase or delivery
This warranty does NOT cover:
- Normal wear and tear
- Damage from misuse, abuse, or accidents
- Modifications or tampering
- Use beyond rated specifications
Disclaimer: EXCEPT AS EXPRESSLY STATED ABOVE, OUR SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
7. Indemnification
In plain English: If your use of our service causes problems that result in claims against us, you agree to cover our legal costs and any damages.
You agree to indemnify, defend, and hold harmless ArcticRx, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of our service
- Your violation of these terms
- Your violation of any law or regulation
- Your cargo or its contents
- Claims by third parties related to your shipments
8. Termination
We can terminate or suspend your access to our service immediately, without prior notice or liability, if you breach these terms. You can also cancel your account at any time by contacting us.
Upon termination:
- Your right to use our service stops immediately
- You must return all rental pods within 30 days
- You're still responsible for any outstanding payments
- We may delete your account data after 90 days
9. Governing Law and Disputes
These terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law principles.
Dispute Resolution: Before filing a lawsuit, let's try to work it out. Contact us at legal@arcticrx.com and we'll attempt to resolve any disputes informally within 60 days.
If we can't resolve the dispute informally, any legal action must be brought in the state or federal courts located in Indianapolis, Indiana, and you consent to the jurisdiction of those courts.
10. Changes to These Terms
We may update these terms from time to time. When we make significant changes, we'll notify you via email or a prominent notice on our website at least 30 days before the changes take effect.
Your continued use of our service after changes become effective means you accept the new terms. If you don't agree with the changes, you can terminate your account.
Pro tip: Check back occasionally. We'll always post the "Last Updated" date at the top.
11. Miscellaneous
Entire Agreement
These terms, along with our Privacy Policy, constitute the entire agreement between you and ArcticRx.
Severability
If any part of these terms is found to be unenforceable, the rest remains in effect.
No Waiver
Our failure to enforce any right or provision doesn't constitute a waiver of that right or provision.
Assignment
You can't transfer your rights under these terms without our written permission. We can assign our rights to any affiliate or successor.
